By accessing or using VerdeBotany.com (the “Site”) and related features, including the AI plant care assistant (collectively, the “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Services.

VerdeBotany provides educational plant care content and an AI assistant that generates personalized guidance based on user prompts. Contact: support@verdebotany.com.

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services. If you use the Services on behalf of an organization, you represent you have authority to bind that organization.

• The Services are for informational and educational purposes only.
• The AI assistant may suggest plant care steps, but this is not professional agricultural, botanical, horticultural, or veterinary advice.
• For urgent or high-stakes situations (e.g., toxic plant ingestion by pets or humans), contact a licensed professional or emergency service immediately.

We strive to reference reputable sources for pet-safety information, but plant toxicity can vary. Always confirm with a trusted source (e.g., your veterinarian). If exposure is suspected, seek professional help immediately.

• Provide accurate information when requesting advice (e.g., species, light conditions, watering habits).
• Use the Services in compliance with applicable laws and these Terms.
• You are responsible for the outcomes of actions taken based on the content or AI outputs.

• Reverse engineering, scraping at scale, or attempting to bypass rate limits.
• Uploading or submitting unlawful, defamatory, hateful, or infringing content.
• Using the Services to create or disseminate malware, spam, or harmful instructions.
• Impersonating others or misrepresenting your affiliation with any person or entity.

• AI-generated responses may be incomplete, out-of-date, or inaccurate; use your judgment.
• We may improve, update, or change models and prompts at any time to enhance quality.
• Do not rely on AI outputs where doing so could cause harm to persons, pets, or property.

• All content on the Site (articles, graphics, layouts, branding) is owned by or licensed to VerdeBotany and protected by applicable laws.
• You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.
• Do not copy, reproduce, modify, distribute, or create derivative works without permission.

If you send feedback, ideas, images, or text (collectively, “Submissions”), you grant VerdeBotany a worldwide, royalty-free, perpetual license to use, reproduce, and display such Submissions to operate and improve the Services. Do not submit content you do not have rights to share.

The Site may contain links to third-party products or retailers. We may participate in affiliate programs and earn commissions from qualifying purchases. Recommendations are for convenience and do not constitute endorsements. Review third-party terms and privacy policies before using those sites.

Your use of the Services is also governed by our Privacy Policy (coming soon). We aim to collect the minimum data necessary to operate and improve the Services.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. VerdeBotany disclaims all warranties, express or implied, including without limitation warranties of accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, VerdeBotany and its owners, affiliates, partners, and contributors shall not be liable for indirect, incidental, consequential, special, or exemplary damages (including loss of profits, data, or goodwill) arising out of or relating to your use of the Services—even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the greater of $100 or the amount you paid (if any) for the specific Service giving rise to the claim.

You agree to defend, indemnify, and hold harmless VerdeBotany from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your Submissions, or your violation of these Terms.

We may suspend or terminate access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, provisions that by their nature should survive will survive (e.g., IP, disclaimers, limitation of liability).

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of state and federal courts located in Arizona, except that either party may seek equitable relief in any court of competent jurisdiction. You and VerdeBotany agree to attempt informal resolution before filing suit.

We may update these Terms from time to time. Material changes will be noted by updating the “Effective Date” above. Continued use of the Services after changes become effective constitutes acceptance of the new Terms.
